Wall Public Library Notice of Policy Adoption

Notice is hereby given that the Wall Community Library has adopted a policy restricting minors’ access to obscene matter or materials, effective January 1, 2025, in compliance with SDCL §§ 22‑24‑56 and 22‑24‑27.

The policy provides that:

• Minors are restricted from accessing obscene material as defined by South Dakota law.

• Public access computers used by minors are equipped with filtering software to block obscene material, child pornography, and material harmful to minors, in accordance with state and federal law.

• Parents and guardians are responsible for supervising their children’s access to library resources and the Internet.

• Patrons under eighteen (18) years of age must have a parent or guardian sign a registration form before a library card is issued.

• The Library does not knowingly collect obscene materials and supports access to constitutionally protected materials.

The policy establishes a formal procedure for requesting a determination of whether any library material is obscene. Requests must be submitted in writing and are reviewed by library staff. Decisions may be appealed to the Library Board and thereafter to the City Council. Any final determination may be subject to judicial review. Materials remain in the collection during the review process.
